Privacy Policy Overview

This privacy policy describes the information collection practices that Hurricane Labs, LLC, follows. Specifically, practices when handling, collecting, or receiving “Personally Identifiable Information” (PII) through our services, content, websites, and user applications (e.g., the Hurricane Labs website and Hurricane Labs Customer Portal) to conduct our business.

PII, by use in US privacy law and information security, is any information that is used on its own or with other information to identify, contact, or locate a single person, or to identify an individual context. 

If you are a resident of the European Union (EU), you may have additional rights under the EU General Data Protection Regulation (GDPR) with respect to your PII. For the purposes of this privacy policy, references to the EU also cover the United Kingdom, Switzerland, and the European Economic Area countries of Iceland, Lichtenstein, and Norway.

Below you will learn what PII of yours we collect. Also, this section outlines how and when Hurricane Labs might use your information. It indicates how we protect your information, as well as who has access to your information. Lastly, how you can correct any inaccuracies you may find in the information. Additional terms and conditions, if any, regarding the collection and use of your information may be provided to you before you sign up for a particular service.

The following discloses Hurricane Labs’ information gathering and dissemination practices. The information below covers the Hurricane Labs website and the Hurricane Labs Customer Portal.

Information we collect from or about you

We collect PII you provide to us through the Hurricane Labs website and the Hurricane Labs Customer Portal. Also, we may collect certain information from our users through server log information, cookies, web analytics, and user supplied information. We do not share or sell the information we collect. Such information may include:

IP Addresses

Hurricane Labs collects IP addresses to conduct system administration and site analysis, for both the Hurricane Labs website and the Hurricane Labs Customer Portal. We also use IP addresses to identify users who refuse to comply with our terms and policies. This also applies to users who threaten Hurricane Labs’ services, sites, users, customers, and others. 

Cookies

The Hurricane Labs website and the Hurricane Labs Customer Portal use cookies during your online session. To clarify, the use of cookies is to help us understand your preferences based on current or previous site activity. These cookies enable us to deliver improved content specific to your interests and offer a better site experience in the future. 

Analytics

Hurricane Labs utilizes Google Analytics as our data processor. Google Analytics is a third party that processes PII on behalf of and according to the instructions of Hurricane Labs. We use Google Analytics to better understand website usage and provide a positive experience for our users. Google Analytics collects various data. Collected information may include user website visit frequency, page visits, and websites viewed prior to the Hurricane Labs website and the Hurricane Labs Customer Portal. 

We use this information to help design, develop, and support the Hurricane Labs website and the Hurricane Labs Customer Portal. This information is also to improve the service offerings of each. To the extent Hurricane Labs uses Google Analytics, Google receives and stores the Hurricane Labs website and the Hurricane Labs Customer Portal contributed site usage information (e.g., pages accessed). However, it does not receive PII or sensitive information as part of this process. 

We honor “Do Not Track” (DNT) signals and do not track, plant cookies, or use advertising when a DNT browser mechanism is in place. It’s also important to note that we do not allow third party behavioral tracking.

Google Analytics Terms of Use and Google Privacy Policies
Google’s ability to use and share information collected by Google Analytics about users through site visits is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. If you do not want data collected by Google Analytics, you can use the Google Analytics Opt-out Browser Add-on

User-Supplied Information

When registering on the Hurricane Labs website and the Hurricane Labs Customer Portal, as appropriate, we may ask you to enter certain information. This may include your Name, Company Name, Email Address, Mailing Address, Telephone Number, Fax Number, Personal Preferences, Location, and other details to help with your experience. The Hurricane Labs website and the Hurricane Labs Customer Portal may also have online surveys and questionnaires. As such, these may ask users for contact and demographic information. 

Our websites are not utilizing payment gateways for financial transactions at this time. Therefore, the Hurricane Labs website and the Hurricane Labs Customer Portal are not collecting, storing, or processing data related to financial transactions. 

We use contact information to contact the user when necessary. Users may opt-in after reviewing the privacy policy and give their consent by clicking the link before submitting any forms. Users may also choose to opt-out of receiving future mailings or contact. More information on opt-in/opt-out preferences may be found below under the Updating Your Information Preferences section. PII will not be disclosed without the user’s prior consent. 

Third Party Disclosure and Links

In order to provide users with greater value, Hurricane Labs may provide links to various third party websites. These third party sites have separate and independent privacy policies. Hurricane Labs therefore assumes no responsibility or liability for content and activities of these linked sites. We provide these destination links only for your convenience, and as such, you may access them at your own risk. However, Hurricane Labs wishes to ensure the integrity of the Hurricane Labs website or the Hurricane Labs Customer Portal and their destination links. So, any feedback about these sites is welcome. We do not sell, trade, or otherwise transfer to outside parties your PII.

How we use your information

Business Use

We use your personal information primarily to facilitate and support ongoing business dealings and interactions with you. This includes processing business transactions you initiate with us regarding orders of services. It also includes establishing and maintaining accounts so that we may provide the services your company requested. Also, we communicate with you and your company about updates, maintenance, or other matters concerning your services. We provide you with the appropriate support and services. And we notify you of any changes or updates to policies, procedures, and services; and responding to inquiries and other necessary information you require about our services. Personal information is required for us to comply with laws and regulations relating to the services we provide. We may use information internally to improve and/or develop our services.

Marketing Purposes

With your consent or as otherwise permitted by applicable law, we utilize your personal information for purposes relating to marketing of content and services. This includes sending you newsletters, press releases, services announcements, or other similar communications regarding our service offerings. As well as marketing or promoting our services to you; soliciting input from you regarding improvement of services; informing you of partner offerings we think your company would benefit from or may be interested in which relate to our services. It also includes any other purposes that we disclose to you at the time of consent.

Referrals

We may receive personal information about you from third parties. This may be individuals or partners, who recommend that we contact you for business purposes. We receive such PII because you have given consent to the third party that they might share your personal information. The use of that information would only be to see if you are interested in our services, or those of our business partners. If you inform us that you are not interested in these services, we will stop contacting you.

How long we retain your personal information

We believe data destruction is important. The information we keep from any Hurricane Labs website and the Hurricane Labs Customer Portal forms visitors submit is kept for 90 days. In some cases, we retain personal data for longer periods of time. We do so if is appropriate and necessary to comply with our legal contracts and obligations, or is otherwise permitted or required by law or regulation.

Updating your information and preferences

Opt-Out Options

The Hurricane Labs website and the Hurricane Labs Customer Portal provide users the opportunity to opt-in to receive communications from Hurricane Labs at the point where Hurricane Labs requests information about the user. In these cases, we process personal data on the consent you grant to us at the time we collect such data. When we process personal data based on your consent, we will indicate as such to you at the point and time of collection.

We also give users the contact options listed below. This provides options for opting-out, changing, and/or removing their information from Hurricane Labs’ database. This is subject to reasonable frequency limitations, which Hurricane Labs establishes as three or fewer requests per year. We may provide web pages or other methods on the Hurricane Labs website and the Hurricane Labs Customer Portal through which you can update subscription preferences. You can also contact us at contact@hurricanelabs.com to update your PII or change your preferences.

Marketing & Customer Account Communications

If you receive marketing email communications from us, you may also opt-out of receiving future email marketing communications. You may do so by following the opt-out instructions within the email. Please note that we reserve the right to send certain communications regarding transactions you initiate. These may include your customer account, your use of our sites, or other business matters. Also these communications may still continue if you choose to opt-out from marketing communications.

Deletion of Records

In accordance with our routine record keeping and applicable law, we may delete certain records that contain your personal information. We are under no obligation to store such information indefinitely. We disclaim any liability arising out of or relating to the destruction of that information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data. This may be due to backups and other reasons. Also, if you post any submissions to a community forum, we generally cannot remove these communications generally.

Information Security

The Hurricane Labs website and the Hurricane Labs Customer Portal have security measures in place. These measures protect the loss, misuse, and alteration of the information under Hurricane Labs’ control. Scanning of the Hurricane Labs website and the Hurricane Labs Customer Portal takes place on a regular basis. We look for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular malware scanning as well.

PII is contained behind networks of a secure nature. It is only accessible by a small number of persons, which we limit, who have special access rights to such systems. It is also a requirement for us to keep the information confidential. In addition, all sensitive information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user places an order or enters, submits, or accesses their information. This is to maintain the safety of your personal information.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States. The concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles, and thee implementation of these principles, is critical to comply with the various privacy laws that protect personal information.

In order to be in line with the Fair Information Practices, we will take the following responsive action: should a data breach occur we will notify users within 72 hours. This policy may change from time to time, so review it frequently.

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email. This act establishes requirements for commercial messages, gives recipients the right to stop emails from being sent to them, and spells out tough penalties for violations. To be in accordance with CAN-SPAM, we agree to the following: If at any time you would like to unsubscribe from receiving future emails, you can email us. We will promptly remove you from all correspondence.

California Online Privacy Protection Act

The California Online Privacy Protection Act (CalOPPA) is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting PII from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy. According to CalOPPA we agree to the following: users can visit the Hurricane Labs website and the Hurricane Labs Customer Portal anonymously. Also, once we create this privacy policy, we will add a link to it on the homepage of the Hurricane Labs website and the Hurricane Labs Customer Portal. Or, as a minimum, it will be on the first significant page after entering either website. We would also like to note, our privacy policy link includes the word ‘Privacy’. Also, we will notify users of any privacy policy changes on our page. Users are able to change their personal information by emailing, calling, or mailing us.

Children’s Privacy Protection

The design of the Hurricane Labs website and the Hurricane Labs Customer Portal is not for children, nor does it target children. Hurricane Labs will not knowingly collect and maintain PII from children 13 years of age or younger. When it comes to the collection of personal information from children, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission (FTC), which is the nation’s consumer protection agency, enforces the COPPA Rule. This rule spells out what operators of websites and online services must do to protect children’s privacy and safety online.

Changes to the Privacy Policy

Hurricane Labs reserves the right to change the terms, conditions, and notices under which our websites are offered. This includes but is not limited to any changes to the use of the Hurricane Labs website or the Hurricane Labs Customer Portal now or in the future. At a minimum, we will review this policy  annually. You are responsible for regularly reviewing these terms and conditions. However, please note that we will give web users the opportunity to opt-out or prohibit uses of their personal information.
